German regulator charges Apple with abuse of power over app tracking tool

Apple is facing fresh regulatory scrutiny in Germany as the country’s competition authority, the Bundeskartellamt, has charged the tech giant with abusing its dominant market position through its app tracking policies. The regulator alleges that Apple’s App Tracking Transparency (ATT) framework creates an unfair advantage by restricting third-party developers from collecting user data while allowing Apple to use similar data for its own advertising purposes.

The investigation, which falls under Germany’s extended antitrust oversight of large digital companies, aims to determine whether Apple’s practices violate fair competition rules. Authorities argue that the ATT framework, introduced as a privacy measure, could be designed to stifle competition by limiting rivals’ ability to track users while strengthening Apple’s control over the digital advertising market.

Apple, however, has defended its policies, stating that ATT was implemented to enhance user privacy by giving consumers more control over how their data is shared. The company denies any wrongdoing and argues that the framework applies equally to all developers. Still, regulators remain concerned that Apple’s internal systems may benefit disproportionately, allowing it to dominate mobile advertising while third-party apps struggle with reduced access to user data.

This latest regulatory action adds to Apple’s ongoing legal battles in Europe, where authorities have been tightening restrictions on Big Tech firms to promote fair competition. If found guilty of anti-competitive behavior, Apple could face substantial fines and be forced to modify its tracking policies. The case also underscores the growing tension between privacy regulations and competition law, as regulators worldwide seek to balance consumer protection with a level playing field for businesses.
